Health Super Financial Services Pty Ltd ABN
37 096 452 318 trading as Health Super Financial Planning ("HSFP") is a
licensed financial planning company that provides this privacy policy
statement for clients and potential clients.
The Privacy Act 1988 and
the Health Records Act 2001
HSFP is regulated by the Privacy Act 1988
("Commonwealth") ("the Privacy Act"), which establishes new rules for
the collection and use of personal information. HSFP is bound by the
National Privacy Principles ("NPPs")* as prescribed in the Privacy Act.
These rules set standards for the protection of your privacy. The
Privacy Act now covers private sector organisations such as ourselves
and covers issues such as the collection, use, security and disclosure
of personal and sensitive information.
HSFP is also bound by the Health Records Act
2001 ("the Health Records Act") and the Health Privacy Principles
("HPPs") contained therein.
Why We Collect Information
HSFP collects information in order to:
- establish you as a client;
- prepare a financial plan;
- administer and invest your assets;
- provide information to you about
investments and strategies; and
- provide financial services and advice to
you.
If information collected by us is inaccurate
or incomplete, it could:
- delay provision of financial advice or
services;
- result in you paying more tax than may
otherwise apply;
- result in the provision of inappropriate
financial advice or services; and
- prevent us from being able to contact
you.

What Type of Information is
Collected and Held By HSFP
Personal information is defined in the
Privacy Act as "information or an opinion (including information or an
opinion forming part of a database) whether true or not, and whether
recorded in a material form or not, about an individual whose identity
is apparent, or can reasonably be ascertained, from the information or
opinion."
The types of personal information that HSFP
collects and holds includes:
- your personal details;
- dependants and nominated beneficiaries;
- tax file numbers;
- contact details;
- details of your assets;
- details of your liabilities and ongoing
expenses;
- employment details;
- salary details;
- insurance cover generally; and
- level of insured death and/or disablement
cover.
Sensitive information is defined in the
Privacy Act as "information or an opinion about an individual’s racial
or ethnic origin, political opinions, membership of a political
association, religious beliefs, or affiliations, philosophical beliefs,
membership of a professional or trade association or trade union,
sexual preferences or criminal record that is also personal
information, or health information about an individual."
HSFP collects and holds the following
sensitive information about you for the purpose of providing financial
information and determining what products would best suit your needs:
- health details; and
- information in personal
statements.Sensitive information is not collected nor is it disclosed
by HSFP without your express consent (unless it is required or is
authorised by law).
Disclosure by HSFP of
Information to Third Parties
There are some instances in which HSFP may
need to disclose your sensitive or health information to others. For
example, disclosure may be made to: insurers, underwriters,
professional advisers, auditors, actuaries, regulatory authorities,
mail houses, other superannuation funds and other investment bodies as
listed on our preferred product list (as it is constituted from time to
time).
HSFP is also required to disclose details of
your personal information where it is expressly required by law such as
to the Australian Taxation Office.
Confidentiality and privacy are important
concerns to HSFP and every effort is made to ensure that this is
reflected in the handling of details by third parties.
Storage of Information
HSFP protects your information from misuse
and loss, modification and disclosure and also from unauthorised
access. HSFP staff can access your personal information for the
purposes of advising you. Information is stored in documents (as a hard
copy), as electronic data or in software or our systems. The security
of this is strictly controlled and monitored by HSFP staff to ensure
data integrity.
Non-current information in both electronic
or hard copy is archived from time to time.
Access to Your Information
If you want access to your personal or
sensitive information held by HSFP, you should identify the information
required in your request. Please direct all requests to the Manager
Health Super Financial Planning, Level 19, 447 Collins Street,
Melbourne VIC 3000
Requests for access can be verbal or written
but will be acknowledged by HSFP in writing within 7 days of the
request, with access granted usually within 14 days.
You may access the details that we hold
about you by either making an appointment to come into our offices in
Camberwell to view them personally or a copy of the information can be
sent to you.
HSFP will not charge you for access to your
personal or sensitive information.
Enquiries and Complaints
About Privacy Issues
If you have any sort of enquiry or require
further information about the way that HSFP handles personal or
sensitive information, please contact the Manager Health Super
Financial Planning.
Please contact us if, for any reason, you
believe that there has been a breach of the Privacy Act. HSFP will
thoroughly examine any possible breaches and will inform you of the
outcome of the investigation.
If clients feel that the Manager Health
Super Financial Planning has not adequately dealt with their complaint,
they may seek to contact either the Privacy Commissioner, or if the
issue is in relation to health information, they may also wish to
contact the Victorian Health Services Commissioner.
